Joan Mielke focuses her practice on all types of health care risk management, regulatory and compliance issues, medical staff issues, employment law, Medicare reimbursement appeals, and civil litigation defense where she represents health care providers in medical malpractice matters and licensing disputes before the Board of Medicine, Board of Nursing, Board of Pharmacy, Board of Dentistry, and Board of Psychology. She also advises clients regarding state and federal reporting requirements, medical staff issues including accreditation requirements, credentialing policies and procedures, peer review disputes, medical staff bylaws, rules and regulations, investigations, and hearings. Ms. Mielke handles a variety of employment law matters including discrimination and related claims pursuant to Title VII of the Civil Rights Act of 1964, the FMLA, ADA, ADEA, FLSA, and OSHA. Ms. Mielke provides advice on employee policies and procedures, employee compensation, overtime, leave and discipline, employment contracts, covenants not to compete, handbooks, separation agreements, and severance plans. Before going into private practice, Ms. Mielke was a law clerk in the Chief Staff Attorney’s Office of the Supreme Court of Virginia. Prior to her legal career, Ms. Mielke dedicated eight years of active duty service in the United States Air Force medical corps where she received several awards for outstanding duty including the Air Force Achievement Medal.
Ms. Mielke is a frequent lecturer and publisher on medical legal issues. She is admitted to practice in the Commonwealth
of Virginia, the United States District Court for the Eastern District of Virginia, the United States District Court for
the Western District of Virginia, and the United States Court of Appeals for the Fourth Circuit.
