Sean Byrne is a director in the firm practicing in the area of civil litigation. He primarily represents hospitals,
physicians, and other health care providers and institutions in the defense of medical malpractice lawsuits, and by
providing health care risk management education and advice. He has represented clients throughout all stages of the
litigation process from incident investigation, pretrial discovery, negotiation or mediation, arbitration,trial, and on
appeal before the Virginia Supreme Court.
Upon graduation from law school at the University of Richmond, Mr. Byrne served as a law clerk to the Honorable
United States Magistrate Judge William T. Prince, in the Norfolk Division of the United States District Court for the
Eastern District of Virginia. Throughout his career, Mr. Byrne has actively litigated civil cases in state courts across
Virginia. He is also admitted to practice in the federal courts including the United States District Courts for the
Eastern and Western Districts of Virginia, the Fourth Circuit Court of Appeals, and the Supreme Court of the United States.
Mr. Byrne is a Virginia Certified Emergency Medical Technician (EMT-B). He has litigated malpractice cases in a wide
assortment of clinical areas, including for example: birth injury cases involving mother and child, surgical complications,
missed diagnoses, emergency medicine and EMTALA litigation, dental and oral surgery cases, cardiac cath / electrophysiology
lab cases, pathology cases, radiology issues, equipment malfunction, medication management, patient falls, patient suicide,
patient confidentiality, and a variety of state and federal regulatory issues. Mr. Byrne has also represented litigants in
general civil litigation matters including premises liability, employment law, collections, breach of contract, and
construction cases.
Mr. Byrne has been an Adjunct Faculty Member at the University of Richmond School of Law since the fall of 2000. He
teaches Lawyering Skills, a two semester course on legal writing, legal research, interviewing, counseling, negotiation,
motions practice, and legal professionalism. He also teaches Medical Malpractice at the School of Law and in the School of
Continuing Studies. Mr. Byrne designed and taught the first law school medical malpractice course of its kind in the country
where physicians and other health care providers enrolled in law school for academic and CME credit to study medical
malpractice with law students. The course was endorsed by the Medical Society of Virginia and a major national professional
liability insurance company and was featured in articles by the Associated Press, Chronicle of Higher Education, and
numerous other national media outlets.
Mr. Byrne frequently gives presentations on civil litigation issues and health care risk management issues. He has
lectured for the Virginia State Bar Speaker's Bureau, and before numerous health care entities including hospital nursing
staffs, medical staffs and health care administrators. Mr. Byrne is the author of a number of articles on various health
care and civil litigation issues, including Access to Health Care for the Hearing Impaired, February 2002,
published by Defense Research Institute in For the Defense, Vol. 44, No. 2, pg. 30 - 33.
